Terms of Service
Last updated: October 22, 2026
These Terms of Service (these "Terms", this "Agreement") are a binding legal agreement between you and HASHBITX (the "Company", "we", "us", "our"), the operator of the HASHBITX platform, including its website, applications, APIs and all services offered through them (collectively, the "Platform"). In these Terms, the "Company" means the operator of the Platform under the trading name HASHBITX, whatever legal form that operator has.
By creating an Account, depositing, trading, or otherwise accessing or using the Platform or any part of it, you accept these Terms in full and agree to be bound by them. If you do not accept these Terms, you must not access or use the Platform. You accept these Terms by clicking to accept, by registering an Account, or by any other actual use of the Platform; electronic acceptance has the same legal force as a handwritten signature.
You should read these Terms together with our Risk Disclosure, which describes the material risks of using the Platform and forms an integral part of this Agreement. Questions can be directed to [support email].
Read together with our Risk Disclosure.
01Acceptance of These Terms
These Terms constitute a legally binding agreement between you and the Company. By clicking to accept, creating an Account, depositing, trading, or otherwise accessing or using the Platform or any of its features, you confirm that you have read, understood and agreed to be bound by these Terms and by any additional terms the Company applies to specific features.
Electronic acceptance has the same legal force and effect as a handwritten signature. If you do not agree to these Terms or to any amendment of them, you must not access or use the Platform; your sole remedy is to stop using the Platform as described in the section titled Amendments to These Terms.
The Company may from time to time issue additional terms for specific features, such as promotions or Earn products. Where those terms conflict with these Terms, the specific terms prevail for that feature.
02Definitions
"Account" means the account you register on the Platform in your own name and through which you use the services.
"AML Laws" means applicable anti-money-laundering, counter-terrorist-financing and sanctions laws, rules and regulations.
"Digital Asset" means a cryptocurrency or token supported by the Platform from time to time, currently including USDT, USDC and SOL.
"Earn" means the locked yield products offered on the Platform.
"Internal Balance" means the accounting record credited to your Account when you deposit, which is a claim against the Company as described in the section titled Internal Balances and Transfer of Title.
"Order" means an instruction you submit on the Platform to buy or sell a Digital Asset.
"Restricted Jurisdiction" means any jurisdiction where use of the Platform is unlawful, and any jurisdiction the Company designates as restricted in its sole discretion.
"Withdrawal" means an instruction to pay out part of your Internal Balance to an external address.
03Eligibility and Your Account
You may use the Platform only if: (a) you are a natural person at least 18 years old, or older where the law of your jurisdiction requires a higher age; (b) you are not a resident, citizen or agent of a Restricted Jurisdiction; (c) you are not acting on behalf of any person who would not qualify; and (d) your use of the Platform is lawful in your jurisdiction.
You may register and maintain only one Account. You must provide accurate, complete and current information and keep it up to date.
You are responsible for keeping your password and access credentials confidential, and for all activity carried out through your Account, whether or not authorized by you. If you suspect unauthorized access to your Account, you must notify the Company immediately at [support email].
The Company may refuse registration, and may suspend, restrict or close any Account, at any time at its sole discretion.
04The Platform
The Platform currently offers spot trading in a selection of USDT-quoted markets, locked yield products under the name Earn, and promotions. The Company determines the markets, assets, products and features offered at any time, and may add, change, suspend or discontinue any of them at any time at its sole discretion, with or without notice.
All trading on the Platform takes place on the Company's internal ledger. The Company acts as the principal counterparty to every Order: there is no peer-to-peer matching of customer Orders and no settlement on any blockchain.
Prices, order books and other market data displayed on the Platform are derived from external sources. The Company does not guarantee that such data is accurate, complete, timely or continuous, or that prices on the Platform correspond to prices on any external venue.
The Platform is made available on an "as is" and "as available" basis. The Company may limit, interrupt or terminate access to the Platform or any feature at any time.
The servers on which the Platform operates may be taken offline at any time, temporarily or permanently, without prior notice and without the Company stating any reason for doing so. If the servers are shut down permanently, all Digital Assets you have transferred to the Company may be permanently destroyed (burned) and your Internal Balance may become zero, with no compensation, refund or recovery of any kind. By depositing or using the Platform, you accept this entirely at your own risk.
05Deposits
Deposits are currently supported only in USDT, USDC and SOL, sent on the Solana network to the deposit address shown in your Account. Each Account is assigned one deposit address. The Company may change supported deposit assets and networks at any time at its sole discretion.
Digital Assets sent on any other network, or tokens other than the supported assets sent to your deposit address, may be permanently lost and are not credited. Any attempt by the Company to recover such assets is voluntary, may be refused, and may carry a fee.
Minimum deposit amounts apply, currently 1 USDT, 1 USDC and 0.01 SOL. Amounts below the applicable minimum are not credited automatically and may be credited manually at the Company's discretion.
Deposits are credited only after the network reaches finality. Displayed confirmation times are estimates only and are not commitments. Deposits of an asset may be paused; deposits received while deposits for that asset are paused are credited only after deposits resume, and may require manual action by the Company.
06Internal Balances and Transfer of Title
When you deposit Digital Assets, they are received into wallets whose keys are controlled exclusively by the Company. From the moment of receipt, all legal and beneficial title to those assets passes to the Company. The Company may hold, pool, stake, lend, use or otherwise dispose of deposited assets at its sole discretion. In exchange, your Account is credited with an Internal Balance denominated in the units of the relevant Digital Asset.
An Internal Balance is a record of a debt the Company owes you. It is not the deposited asset itself, and it does not represent any specific, identifiable or segregated coins held for you. In particular, an Internal Balance: (a) is not a Digital Asset and cannot be transferred on any blockchain; (b) is not electronic money, a bank deposit, a security or any other regulated financial instrument; (c) is not covered by any deposit guarantee, investor compensation or insurance scheme of any kind; (d) is payable only through a Withdrawal that the Company approves and executes under these Terms, and is otherwise not redeemable on demand and has no fixed maturity; and (e) may have no market value and may become entirely worthless.
All trading on the Platform takes place between Internal Balances and settles exclusively on the Company's internal ledger. No transaction placed on the Platform settles on any blockchain.
You bear the entire risk of holding Internal Balances, including the risk of total loss described in the Risk Disclosure.
07Withdrawals
Withdrawals are currently supported only in USDT and USDC, paid to external addresses on BNB Smart Chain (BEP20), Arbitrum One, Base or Tron (TRC20). Other Digital Assets, including SOL, cannot currently be withdrawn; you may trade such balances into a withdrawable asset where markets allow. The Company may add, remove or change supported withdrawal assets and networks at any time at its sole discretion.
Every Withdrawal request is manually reviewed by the Company before any funds are sent. Review is usually completed within 30 minutes during normal operation, but this is an estimate and not a commitment. The Company does not guarantee any processing time and may take longer, including where review, verification, liquidity management or security considerations apply.
Minimum amounts and fees are shown at the time you submit a request. They are currently a minimum of 10, and a fee of 1 on BNB Smart Chain, Arbitrum One and Base and 2.5 on Tron, in the asset being withdrawn. The Company may change minimums, fees and other conditions at any time without prior notice; the amounts confirmed when you submit a request are the amounts that apply to that request.
Per-Withdrawal and rolling 24-hour limits apply. They are currently 5,000 USD per Withdrawal and 20,000 USD per 24 hours, and may be changed at any time. The Company may also apply lower limits to your Account individually.
For security reasons, Withdrawals may be delayed for up to 24 hours or longer after a password change or reset, an email address change, or any other event the Company treats as security-relevant. The Company may lock withdrawals on an Account for up to 365 days where it suspects fraud, account compromise, a breach of these Terms or an AML concern.
The Company may approve, delay, cancel or reject any Withdrawal at its sole discretion. A rejected or cancelled Withdrawal releases the locked amount back to your Account, less any third-party costs the Company has already incurred for the attempt. The Company may execute Withdrawals through third-party bridge and liquidity providers; delays, failures and losses caused by such providers are at your risk as described in the Risk Disclosure.
You are solely responsible for the correctness and compatibility of the destination address you provide. Blockchain transactions are irreversible, and funds sent to a wrong or incompatible address may be lost with no possibility of recovery. The Company may require that a destination address be owned or controlled by you. The Company may suspend Withdrawals in whole or in part at any time, including for maintenance, liquidity management, security, AML or regulatory reasons or events beyond its control, and is not liable for losses caused by any such suspension.
08Trading and Orders
You may place market and limit Orders in the markets offered. Each Order is executed against the Company as counterparty, at prices derived from the Platform's order books.
Trading fees are currently 0% per trade, charged in the asset received. Minimum order sizes and minimum notional values apply, currently a minimum notional of 5 USDT. Orders may be rejected where executable prices deviate from displayed prices beyond the applicable limit, currently 1.5% for market Orders; where market data is stale; where a market is halted; where the balance is insufficient; or for any other reason the Company determines.
The Company may at any time halt trading in any market, cancel open Orders, adjust fees, minimums and other trading parameters, or delist an asset, in each case at its sole discretion and without liability.
Nothing on the Platform is a recommendation or advice of any kind. You decide whether, when and how to trade, and you are solely responsible for your Orders and their outcomes.
09Earn Products
Earn products allow you to lock an Internal Balance of a supported asset for a fixed term in exchange for a yield displayed at subscription. Terms currently run 7, 30 and 90 days. The rate confirmed when you subscribe applies to that position; rates and terms for new positions may change at any time.
The principal of an Earn position is locked for the full term and cannot be released early, except at the Company's sole discretion. Position size minimums, per-position caps and total caps apply per product and may change at any time.
Yield under an Earn product is paid by the Company out of its own resources. It is not generated by an on-chain investment made on your behalf, and it is not guaranteed income. The Company may suspend, modify or discontinue Earn products at any time.
10Promotions
The Company may offer promotions, bonuses, fee benefits or other incentives at its sole discretion. Promotions may be modified, restricted or withdrawn at any time, and may be subject to additional terms published with them.
The Company may determine, at its sole discretion, that a person has abused a promotion, for example by maintaining multiple Accounts, acting in coordination with others, exploiting pricing, display or execution errors, or using a promotion in a way inconsistent with its intended purpose.
Where the Company determines that abuse, fraud or a breach of these Terms has occurred, it may, at its sole discretion: (a) cancel or withdraw any promotion or related benefit; (b) reverse related trades or Orders at prices the Company determines; (c) deduct promotional amounts and related gains from balances; (d) forfeit bonuses, winnings and gains obtained through such conduct; and (e) suspend, restrict or close the Account.
11Fees
Fees, minimums, limits and other charges applicable to the Platform are those displayed on the Platform at the relevant time. All of them may be changed at any time and from time to time, without prior notice.
A change to a fee or charge applies to transactions carried out after the change takes effect. It is your responsibility to check the applicable fees, minimums and limits before transacting.
12Taxes
You are solely responsible for determining and paying any taxes arising from your use of the Platform, in whichever jurisdictions apply to you. The Company does not provide tax advice and does not withhold or remit taxes on your behalf except where required by law.
13AML, KYC and Sanctions
The Company may at any time request information and documents to verify your identity, address, source of funds or other relevant matters, and to comply with AML Laws, including sanctions screening. Verification may be requested at onboarding, periodically, or in connection with specific transactions such as Withdrawals.
If you fail to provide requested information, or the information provided is unsatisfactory to the Company, the Company may suspend, restrict or close your Account, freeze balances, and cancel, delay or reject Withdrawals pending review, in each case at its sole discretion and without liability.
You represent and warrant that: (a) you are not a person designated under applicable sanctions regimes, nor acting for or on behalf of such a person; (b) the funds you deposit do not derive from illegal activity; and (c) your use of the Platform does not violate AML Laws.
The Company may take any action required by AML Laws or requested by competent authorities, including freezing balances, cancelling transactions, forfeiting funds and making reports to authorities, and has no liability for such actions taken in good faith.
14Prohibited Conduct
In connection with the Platform you must not: (a) use the Platform if you do not meet the eligibility requirements; (b) provide false, inaccurate or misleading information; (c) create or use more than one Account, or create an Account for another person without authorization; (d) manipulate or attempt to manipulate markets, prices or the execution of Orders; (e) exploit any error, bug, delay or fault of the Platform or its data sources, or knowingly transact at obviously erroneous prices; (f) gain unauthorized access to, interfere with, test the vulnerability of, or overload the Platform; (g) use the Platform for illegal purposes or in breach of these Terms; or (h) assist any third party to do any of the above.
Where the Company determines that a prohibited act has occurred, it may reverse related transactions, forfeit related gains and balances, suspend, restrict or close the Account, and pursue any available legal remedy, without limitation by any other provision of these Terms.
15Suspension and Termination
The Company may suspend, restrict or terminate your access to the Platform or any feature, and may close your Account, at any time at its sole discretion, with or without notice and with or without stating a reason, including where it considers it necessary for security, AML, legal, regulatory or business reasons, or where you have breached these Terms.
On suspension or termination: open Orders may be cancelled; Earn positions remain locked until maturity unless the Company decides otherwise; and balances may be withdrawn only where and to the extent the Company permits it under these Terms, or may be forfeited where permitted for cause. The Company may set off amounts you owe it against any balance.
You may stop using the Platform at any time. Provisions that by their nature are intended to survive termination, including ownership, liability, indemnification and governing law, survive.
16No Warranties
Except as expressly stated in these Terms, the Platform is provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, title, accuracy and non-infringement.
The Company does not warrant that the Platform will be available, uninterrupted, timely or error-free, that defects will be corrected, or that third-party data or services used by the Platform will be accurate or available. The Company does not warrant that the Platform is lawful or available in your jurisdiction; you are responsible for the legality of your own use.
17Limitation of Liability
To the maximum extent permitted by law, the Company is not liable for any indirect, incidental, special, consequential or exemplary damages, lost profits, lost savings, loss of data or trading losses, even if the Company has been advised of the possibility of such damages.
The Company's total aggregate liability arising out of or relating to the Platform, the services or these Terms, for all claims combined, is limited to the total amount of fees actually paid by you to the Company in the twelve months preceding the event giving rise to the claim.
The Company is not liable for failures or delays caused by events beyond its reasonable control, including failures of blockchain networks, third-party bridges, data providers, communication systems or utilities, attacks by third parties, and governmental action.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited by applicable law.
18Indemnification
You indemnify the Company, its affiliates, and their officers, employees and agents against any claims, actions, losses, damages, costs and expenses (including legal fees) arising out of or relating to: (a) your use of the Platform; (b) your breach of these Terms; or (c) your violation of any law or the rights of any third party.
19Risk Acknowledgment
You confirm that you have read, understood and accepted the Risk Disclosure published in the Legal section of the Platform, which forms an integral part of these Terms.
You understand and accept that: (a) Digital Assets are highly volatile and you may lose the entire amount you deposit; (b) your Internal Balances are unsecured claims against the Company and may become worthless; and (c) your use of the Platform is entirely at your own risk.
20Intellectual Property
The Platform, including its software, design, text, graphics, trademarks and other content, is owned by the Company or its licensors and is protected by intellectual property laws.
The Company grants you a limited, revocable, non-exclusive and non-transferable right to access and use the Platform for personal, lawful purposes. You must not copy, modify, distribute, sell, scrape or otherwise exploit the Platform or any part of it beyond this right.
21Notices and Electronic Communications
The Company may give notices under these Terms by email to your registered email address or by publishing a notice on the Platform. An email notice is deemed received when sent; a notice published on the Platform is deemed received when published.
You agree that the Company may communicate with you electronically. Electronic communications have the same legal effect as communications in paper form and are admissible in evidence.
22Amendments to These Terms
The Company may amend, supplement or replace these Terms, and any policy, fee, limit, list of supported assets or networks, or other term applicable to the Platform, at any time and at its sole discretion, for any reason or no reason.
An amendment takes effect at the time it is published on the Platform, or at a later date stated in it. The Company may, but is not obliged to, notify Account holders of amendments, including material ones, by email or by a notice on the Platform. It is your responsibility to check these Terms and the information displayed on the Platform for changes before and while using the services.
Your continued access to or use of the Platform after an amendment takes effect constitutes your acceptance of the amended Terms. If you do not accept an amendment, your sole and exclusive remedy is to stop using the Platform and, where the Terms then in force permit, request a Withdrawal of your Internal Balance. No amendment gives rise to any liability of the Company for features, prices, limits or availability that existed before the amendment.
23Governing Law and Disputes
These Terms, and any dispute arising out of or relating to them or to the Platform, are governed by the laws of Curaçao, without regard to its conflict-of-laws rules.
The courts of Curaçao have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Platform. You submit to this jurisdiction and waive any objection based on venue or inconvenient forum.
Before filing proceedings, the parties will attempt in good faith to resolve a dispute for 30 days from written notice of it.
Disputes must be brought on an individual basis. To the extent permitted by law, neither you nor the Company will bring or participate in a class, collective, consolidated or representative action, and you waive any right to do so in relation to disputes covered by these Terms.
Any claim must be filed within one year after the event or facts giving rise to it, regardless of any longer statutory limitation period; claims not filed within that period are permanently barred.
24Miscellaneous
If any provision of these Terms is found invalid or unenforceable, it will be modified to the minimum extent necessary or severed, and the remaining provisions stay in force.
These Terms, together with the Risk Disclosure and any specific terms published for individual features, are the entire agreement between you and the Company on their subject matter, and supersede all prior agreements and understandings on that subject matter.
The Company may assign or transfer these Terms and any of its rights or obligations under them. You may not assign or transfer any of your rights or obligations under these Terms.
A failure or delay by the Company in enforcing a right under these Terms is not a waiver of that right or of any other right.
No person other than the parties to these Terms has any rights under them. Headings are for convenience only and do not affect interpretation. If the Company provides a translation of these Terms, the English version controls in case of conflict.
